I think you meant to say something else here. The dialog isn't modal. See: http://en.wikipedia.org/wiki/Modal_window

You can interact with the application while the dialog is present (even though the rest of the update app has no UI, so not much point).

Sorry, I meant the dialogue should not be a transient window (per Wikipedia's definition). Transient windows still blocks the user's view of other windows and impede their workflow, which is unnecessary for an updater.
